Course Information
The Advanced Course in Arbitration is the product of several years of joint research by the International Center for Arbitration, Mediation, and Negotiation (CIAMEN) and the Chartered Institute of Arbitrators (CIArb) in London, England.
This program aims to introduce the concept of alternative dispute resolution (ADR) and provide a comprehensive examination of arbitration as a means of resolving disputes.
The prestigious faculty and academic rigor of both institutions ensure that, through an intensive course, participants will acquire the knowledge necessary not only to represent parties in arbitration proceedings but also to serve as arbitrators.
This is the first arbitration course in Spanish offered as part of the “Recognized Course Provider (RCP)” program, and successful completion of the course enables participants to subsequently apply for accreditation as a Member (MCIArb) of the Chartered Institute of Arbitrators.
What does the program offer?
This program offers a fast track to becoming a CIArb Member. It is the only arbitration course taught in Spanish by a Spanish university that leads to this accreditation.
The program takes place over an intensive week in Madrid (Spain), the hub of the Spanish refereeing community and a gateway to Latin America.
The course instructors are recognized referees and experts in their respective fields.
Summary and Objectives
Arbitration is a private legal institution in which disputes are removed from the state court system by mutual agreement of the parties and resolved by individuals empowered to render final decisions. Arbitration is an alternative to the ordinary court system designed to resolve disputes and offering certain advantages over judicial proceedings.
Its multidisciplinary nature stems from the fact that, in the field of law, it encompasses issues in civil, procedural, commercial, and international law, although it may also extend beyond the legal sphere to fields such as engineering, architecture, or other areas of specialized knowledge.
We have summarized its main features here:
It is a form of “consensual justice”
Commercial arbitration arises from a contract in which the parties agree to submit their disputes to an impartial third party, based on the principle of contractual freedom. This creates an expectation that the outcome will be more efficient than a court judgment.
It is a hybrid and confidential method for resolving legal disputesº
Heterocomposite methods involve an impartial arbitrator resolving the dispute in accordance with the parties’ instructions and the law. The confidentiality of arbitration ensures that matters are not disclosed to unauthorized third parties, thereby protecting reputational value and trade secrets.
It is a fast track for resolving legal disputes
Arbitration aims to resolve disputes in a timely manner in order to maintain legal and commercial relationships and meet the needs of businesses and citizens.
It is a flexible, specialized alternative to the court system.
The parties to a dispute may choose arbitration to resolve the conflict and seek justice in a more flexible and specialized setting, where they can defend their rights and have greater control over the process.
The referee’s role will be to resolve the dispute
There must be a dispute over rights that the parties believe they hold, which will be resolved by arbitrators in a streamlined, informal proceeding.
The resolution of the conflict is final
Arbitration provides a final and binding resolution, just like a court judgment.
